All orders are subject to these Terms and Conditions. Supplier’s acceptance of Customer’s PO is expressly conditioned upon Customer’s agreement to these Terms and Conditions.
IMPORTANT NOTICE: Prices subject to change without notice. All statements, technical information and recommendations related to the Seller’s products are based on information believed to be reliable, but the accuracy or completeness thereof is not guaranteed. Before utilizing the product, the user should determine the suitability of the product for its intended use. The user assumes all risks and liability whatsoever in connection with such use. Any statements of recommendations of the Seller which are not contained in the Seller’s current publication shall have no force or effect unless contained in an agreement(s) signed by an authorized officer of Seller.
FIS Blue warrants that a product will be free from defects in materials and workmanship and conforms to FIS Blue Specifications. The warranty period for a product is a specified, fixed period commencing on the customer’s date of purchase. A valid proof of purchase may be required. If the customer does not have a valid proof of purchase, the warranty period will be measured from the date of sale indicated within FIS Blue records. If, during the warranty period, the product is not in good working order, FIS Blue may, at its option, repair or replace it at no additional charge, except as is set forth below.≈
The warranty period for products sold and manufactured by FIS Blue is as follows:
All products, excluding test equipment: 30 Days
FIS manufactured test equipment: 1 year
Distributed test equipment: Original manufacturer’s warranty applies
Items Not Covered by Warranty
FIS Blue does not warrant uninterrupted or error–free operation of product or equipment. Unless specified otherwise, FIS Blue references the original equipment manufacturer’s warranty and its subsequent requirements on non–Fiber FIS Blue products. Any technical or other support provided for a product under warranty, such as assistance via telephone with “how–to” questions and those regarding use, setup and installation, will be provided WITHOUT WARRANTIES OF ANY KIND.
The warranty does not cover the repair or exchange of a product resulting from misuse, accident, modification, unsuitable physical or operating environment, improper maintenance by the customer, or failure caused by a product for which FIS Blue is not responsible. The warranty may be voided by removal or alteration of product, parts, security or identification labels.
THESE WARRANTIES ARE THE CUSTOMER’S EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THESE WARRANTIES GIVE THE CUSTOMER SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF EXPRESS OR IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO THE CUSTOMER. IN THAT EVENT, SUCH WARRANTIES ARE LIMITED IN DURATION TO THE WARRANTY PERIOD. NO WARRANTIES APPLY AFTER THAT PERIOD.
Warranty service may be obtained from FIS Blue by returning a Return Material Authorization Form (RMA), during the warranty period for the FIS Blue-manufactured product, to FIS Blue’s Quality Assurance Manager. The customer may be required to present proof of purchase or other similar proof of warranty entitlement. The customer may be responsible for any associated transportation charges, duties and insurance. The product, once arriving at FIS Blue, will be evaluated to determine cause of failure, with warrantee action determined from evaluation.
